Judge Orders Mistrial On One Charge In Accused Polygamist’s Child Abuse Trial
LENOIR, N.C. -- A Caldwell County judge has declared a mistrial on one charge levied against a man accused of felony child abuse for circumcising his sons at home.
Johnnie Marlowe admitted during his trial to using a box cutter to circumcise two of his sons, but he said he was acting on the will of God, not abusing his children.
He said he also circumcised himself at the age of 30, and another son while living in Mecklenburg County.
Marlowe lived with two women he called his wives and 13 children.
After several hours of deliberation Thursday, the jurors said they had decided to convict Marlowe of one misdemeanor count of child abuse.
Marlowe began tearing up when the verdict was read.
The jurors said they were hung 11-1 on the second charge of child abuse, which related to a son who bled for 12 hours after the procedure.
The jury could have convicted him of felony child abuse or misdemeanor child abuse, or they could have acquitted him of the charge.
The judge ordered a mistrial on that charge.
Deliberations are ongoing in the sentencing phase of the trial.
Marlowe could have been given eight years in prison if convicted of two felony counts of child abuse.

Accused Polygamist Receives 150 Days For Child Abuse Conviction
LENOIR, N.C. -- Accused polygamist Johnnie Marlowe has been sentenced to 150 days in jail after being convicted of one misdemeanor count of child abuse.
The sentenced was handed down in a Caldwell County courtroom on Friday for the circumcision on his son with a box cutter.
Marlowe has already been sentenced to 12 years in prison for kidnapping and assaulting his two wives.
